Terms of Service

1. Terms

By accessing the website at https://pilotpocket.app or downloading and using the PilotPocket mobile application, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. Use License

1. Permission is granted to download and use the PilotPocket application for personal, non-commercial use. This is the grant of a license, not a transfer of title, and under this license you may not:
   1. modify or copy the application or its materials;
   2. use the application for any commercial purpose, or for any public display (commercial or non-commercial);
   3. attempt to decompile or reverse engineer any software contained in the PilotPocket application;
   4. remove any copyright or other proprietary notations from the materials; or
   5. transfer the application to another person or "mirror" the materials on any other server.
2. This license shall automatically terminate if you violate any of these restrictions and may be terminated by PilotPocket at any time.

3. Subscriptions & In-App Purchases

PilotPocket offers subscription-based and one-time purchase options through Apple In-App Purchase. By purchasing a subscription or one-time purchase:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
• Refunds are handled by Apple according to their refund policy.

4. Digital Certificates & Apple Wallet

PilotPocket provides the ability to generate digital representations of your drone pilot certificates for use in Apple Wallet. Please note:

• Digital passes generated by PilotPocket are digital representations of your official certificates and are provided for convenience only.
• PilotPocket does not issue, validate, or replace official EASA or national aviation authority certificates.
• You are responsible for ensuring your official certificates remain valid and up to date.
• PilotPocket is not liable for any consequences arising from the use of digital passes in place of official documents.

5. Disclaimer

1. The materials and services provided by PilotPocket are provided on an 'as is' basis. PilotPocket makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
2. PilotPocket does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials or services, including but not limited to pre-flight checklists, certificate expiry reminders, or regulatory information.
3. PilotPocket is not a substitute for professional aviation safety advice. Users are responsible for complying with all applicable drone regulations in their jurisdiction.

6. Limitations

In no event shall PilotPocket or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the PilotPocket application or services, even if PilotPocket or a PilotPocket authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

7. Accuracy of Materials

The materials and information appearing in the PilotPocket application could include technical, typographical, or factual errors. PilotPocket does not warrant that any of the materials are accurate, complete or current. PilotPocket may make changes to the materials at any time without notice. However PilotPocket does not make any commitment to update the materials.

8. Links

PilotPocket has not reviewed all of the sites or services linked to from its application and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by PilotPocket of the site. Use of any such linked website is at the user's own risk.

9. Modifications

PilotPocket may revise these terms of service at any time without notice. By using this application you are agreeing to be bound by the then current version of these terms of service.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Berlin, Germany and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
